La recinzione dei misteri
Sono ormai diversi anni che, in località “Belvedere”, a Formia, in adiacenza alla proprietà Di Gennaro, fa bella mostra di sé una recinzione “anonima”, che impedisce alle persone di affacciarsi dall’attiguo terrazzo per godersi il meraviglioso panorama di cui madre natura ha dotato la nostra città.
Vista la persistenza della cosa, noi ci siamo posti le nostre consuete domande: a che serve ?
Ci viene da pensare che, a seguito dei lavori fatti sulla scarpata che dalla via Appia degrada fin sulla spiaggia, ci sia un pericolo di frana: ma questa è solo un’ipotesi, poiché sul posto non vi è apposta alcuna segnalazione che chiarisca il perché della recinzione e quali siano i problemi che interessano il terrazzo.
Quindi, chiediamo al Comune di Formia di fare chiarezza sulla funzione di questa recinzione e, qualora sia stata impedito l’accesso alla balaustra per un qualunque stato di pericolo, di segnalarlo debitamente, poiché spesso si vedono persone che, ignare di tutto, accedono comunque alla balaustra. Qualora, invece, la recinzione sia stata posta da terze persone per non precisati motivi, allora se ne chiede l’immediata rimozione, segnalando all’autorità giudiziaria gli eventuali reati.
D’altronde, è un continuo fiorire, nel nostro comune, di cantieri anonimi. Ma noi non ci arrendiamo, e per questo continueremo nel chiedere il rispetto della legalità, parola che in teoria piace a tutti, ma che nella pratica non riceve un grande gradimento, in particolare dalle istituzioni, che invece dovrebbero essere in prima fila nell’opera di controllo e di prevenzione affinché ciò che denunciamo non avvenga.
Con l’occasione, chiediamo conto dello stato del ricorso al TAR del Lazio – Sez. distaccata di Latina, notificato al Comune di Formia il 12.01.2011, proposto dai Sigg. Di Gennaro Vincenzo e Di Gennaro Sergio, per l’annullamento: “dell’Ordinanza n. 355 del 09.11.2010, notificata il giorno 11 dello stesso mese, con la quale è stata ordinata la demolizione di opere ritenute abusive, comprese quelle di consolidamento e di messa in sicurezza della scarpata antistante il villino di proprietà dei ricorrenti e, contestualmente, è stato ordinato di provvedere alla contestuale e immediata messa in sicurezza della scarpata interessata dai movimenti franosi sia quelli in atto e sia quelli che possano eventualmente derivare dalle operazioni di ripristino dello stato originario dei luoghi, con la precisazione che le opere comportanti modificazioni permanenti dello stato dei luoghi dovranno essere autorizzate dagli organi competenti in materia. Nonché per la declaratoria della sopravvenuta inefficacia della stessa a seguito di presentazione di istanza di accertamento di conformità” e contro cui il comune di Formia si è costituito dando mandato all’avvocatura comunale (Delibera di giunta n.71 del 31 Marzo 2011).
Il primo dei due firmatari del ricorso è anche titolare di una delle tre licenze rilasciate dal comune di Formia per l’attività di noleggio delle attrezzature balneari delle spiagge libere nel “LITORALE DI LEVANTE TRATTO B LOC. TORRICELLA COMPRESA TRA LIDO BAIA DELLA GHIAIA E ALBERGO MIRAMARE”.
Visto come stanno le cose, è lecito chiedersi se tra la recinzione anonima e l’ordinanza n. 355 del 09.11.2010 vi sia qualche legame da tenere oscuro a quanti, in una bella giornata di sole, è impedito di affacciarsi da quel pubblico terrazzo.
