Spiagge, poche luci e molte ombre
Il sindaco Forte ha vietato, con ordinanza n.28 del 29 Aprile 2011 pubblicata sull’albo pretorio online, la balneazione in due zone del litorale della nostra città. La prima è in prossimità del porto (ex spiaggia della salute), la seconda in prossimità della foce del torrente S. Croce (300 a sinistra e 700 metri a destra posizionandosi con le spalle rivolte al mare).
Non proprio una bella notizia per una stagione turistica all’inizio. A questo punto ci aspettiamo che il sindaco Forte sia oggetto delle stesse accuse rivolteci l’anno scorso dall’assessore Aldo Zangrillo quando intervenne duramente sulla stampa contro coloro (il nostro circolo ndr) che arrecavano grave danno ad immagine e credibilità di imprenditoria e indotto turistico locale, in quanto rei di aver denunciato l’inquinamento rilevato in quei tratti di costa, nonché di aver chiesto le ragioni del mancato divieto di balneazione.
Allora, l’assessore all’ambiente sostenne, sulla base di “presunti” rilievi dell’ARPA Lazio in suo possesso, che il mare di Formia fosse pulito. Senza considerare peraltro, che proprio i dati pubblicati dall’ARPA Lazio, da noi immediatamente consultati, lo smentissero evidenziando quello che sostenemmo noi un anno fa e che oggi il comune certifica (con speranza che s’informi l’assessore dell’ordinanza).
Entrando nel merito della balneabilità della costa, abbiamo scoperto che l’ordinanza segue il Decreto Presidenziale della Regione Lazio n. T0128 del 14.04.2011 che indica le zone de “la salute” e la foce del S. Croce non balneabili. Se si osserva la relativa serie storica, si nota come la zona della FOCE DEL RIO SANTACROCE: 1) fino al 2009 era solamente inquinata e quindi vigeva il divieto di balneazione, 2) dal 2010 è classificata come Zona permanentemente interdetta alla balneazione per motivi diversi dall’inquinamento (zone portuali, militari, foci di corsi d’acqua, ecc.), ciò significa che la balneabilità nei pressi del rio S.Croce è comunque vietata, a prescindere da fattori inquinanti (es. Streptococchi fecali e Coliformi totali).
Pertanto esclusa da analisi di routine, ragion per cui non sono più presenti sul sito Arpa dati a partire da giugno 2010. (fino alla data del 30/06/2010 D.p.r. N.470/82 mod. dall’art. 17 del D.lgs N.116/08, a partire dalla data del 01/07/2010 Decreto 30/03/2010 e D.lgs N.116/08). Lasciando – per il momento – il mare passiamo alle spiagge. In particolare alle concessioni per l’uso gli arenili, altro tema caldo per la giunta, che approccia la questione con la solita strumentale confusione, utile solo a favorire interessi particolari. Nei giorni scorsi il comune, come anticipato oltre un anno fa dall’assessore Assaiante, ha pubblicato sull’albo pretorio online due atti molto appetitosi per chi ha interesse a trarre profitto dallo sfruttamento del pubblico demanio marittimo.
Il primo atto è la determinazione del settore urbanistica ed edilizia n.44 del 26.04.11, avente ad oggetto l’organizzazione delle spiagge libere in attuazione dell’art. 26 del regolamento Gestione Demanio marittimo, come previsto dalla deliberazione di giunta comunale n.95 datata 15.04.11. Peccato però che per il cittadino comune l’accesso alla importante delibera, nonché agli allegati A1 e A2 della determinazione sia molto difficile. Infatti, abbiamo provato a cercare sul sito del comune gli atti in questione, senza alcun risultato. Tanto da la misura della trasparenza nel comune di Formia.
Noi abbiamo motivo di ritenere, secondo quanto detto dall’assessore Assaiante il 18 Marzo 2010, che gli atti in questione riguardino le gare per le concessioni di 7 lotti così ripartiti: n. 1 sul litorale di Vindicio e n. 6 a S. Janni, litorale di Levante. Chi lo sa? Attendiamo una risposta. Ad aumentare la confusione sulle spiagge sta l’esito del precedente bando di gara, di cui si è persa traccia, da quando coloro che furono esclusi dall’affidamento fecero ricorso al TAR. Da allora nulla più è stato detto, pertanto non è dato sapere né se sentenza è stata data né il merito.
Non vorremmo in sintesi che per non scontentare nessuno la giunta Forte abbia annullato tutto per provvedere nuovamente alla distribuzione delle concessioni. Sempre in tema di spiagge, il secondo atto – determinazione n.45 del settore urbanistica ed edilizia del 29.04.11 – sebbene con qualche problema tecnico iniziale, a causa di un problema del server del comune, quindi pubblicata correttamente il 04.5.2011, riguarda i criteri di valutazione delle offerte per l’affidamento dell’attività di noleggio di attrezzature balneari su arenili liberi.
Anche qui. Manca l’allegato A ma, e soprattutto, il numero totale di affidamenti, forse supponiamo presenti in quella delibera di giunta n.95/15.04.11, a cui si fa riferimento ma di cui alla persona comune non è dato conoscerne il contenuto. Noi provvederemo a chiederne copia, non meravigliandoci se, all’esito della richiesta, ci si rispondessero come nel caso della richiesta per il servizio di mensa scolastica, con la formula “quale sia l’interesse giuridico da tutelare sotteso alla richiesta stessa”, una vera assurdità per un cittadino interessato ad informarsi sull’andamento della cosa e dei servizi pubblici. I casi esposti evidenziano come la trasparenza in questo comune sia un tema delicato della pubblica amministrazione.
Lenin sosteneva che per Marx lo stato è l’organo del dominio di classe, un organo di oppressione di una classe da parte di un’altra. La giunta Forte, alla sua scala, con la puntuale difesa dei suoi interessi contro quelli dei suoi avversari. Con l’ostinazione con cui osteggia chi non appartiene alla sua schiera, rende perfettamente l’idea di come lo stato possa essere uno strumento usato da una parte contro l’altra, in sfregio al principio secondo cui il sindaco è il sindaco di tutti.
Come se non bastasse, a peggiorare la situazione delle “spiagge” è arrivato l’ennesimo decreto sviluppo del governo Berlusconi, che vorrebbe disporre su “i litorali su cui insistono chioschi e varie strutture turistiche saranno oggetto di diritto di superficie con una durata di 90 anni”, regalando a quattro spicci al concessionario, per far cassa, che estensione a 90 anni dello sfruttamento del demanio marittimo.
Una edizione rivista ed aggiornata del livello medievale. Ciò nonostante l’Ue chieda da anni che le concessioni siano affidate all’asta, come sarà dal 2015 quando scade la proroga concessa all’Italia. Il provvedimento svela la vera natura del centro destra alla disperata ricerca di consenso in vista della prossima campagna elettorale. La stessa UE – per nulla socialista – ha chiesto all’Italia chiarimenti sul decreto “balneare”, in palese contrasto con le norme comunitarie che in tema di concessioni prevedono una durata tale da garantire l’apertura alla concorrenza.
Da noi i liberisti sono tali sono a chiacchiere, anzi no!! Solo quando si tratta di attaccare i diritti dei lavoratori. Infatti, i presunti liberal-liberisti sono tali solo con i corpi dei precari e dei lavoratori a cui chiedono di adeguarsi al mercato globale, mentre ai loro amici, verso i loro produttori di pacchetti di voti, si offre ogni cura e tutela, anche e soprattutto contro l’interesse generale.
